1. Introduction

By registering as an Artist on FINEART.gallery (the “Platform”), you enter into a legally binding agreement with SARL ARTEFACT COLLECTION, which operates and owns the Platform. These Terms & Conditions govern the relationship between you, the Artist, and FINEART, and outline your rights, obligations, and responsibilities when submitting artworks for sale and receiving commissions.

2. Artist Eligibility & Artwork Approval

Participation in the Platform is open to professional artists who submit original artworks that meet FINEART’s technical, artistic, and quality standards.

All uploaded files must respect the requirements detailed in the Submission Guide, including resolution, format, and technical specifications. Submissions that do not meet these requirements may be rejected or require resubmission.

FINEART reserves the right, at its sole discretion, to approve or reject any artist or individual artwork without justification. Approval of one artwork does not guarantee acceptance of future submissions. Any decision by FINEART is final and binding.

3. Pricing, Commission & Taxes

Artworks are sold in standardized formats at fixed retail prices (exclusive of taxes), with commissions defined as follows:

  • SMALL: €100 (Artist Commission: €30)
  • MEDIUM: €200 (Artist Commission: €60)
  • LARGE: €375 (Artist Commission: €120)
  • LUXE: €625 (Artist Commission: €240)

EU-based artists will receive commission payments plus 20% VAT where applicable, in accordance with EU tax regulations. Non-EU-based artists will receive commission payments with 0% VAT, but may be responsible for declaring income in their home jurisdiction.

The prices and commission structure may be updated by FINEART with reasonable notice to artists. Continued use of the Platform after such updates constitutes acceptance of the new conditions.

4. Payments

Artist commissions are disbursed once per month, on the 28th day of the month, via PayPal only. A valid PayPal account linked to the Artist’s Vendor Dashboard is required in order to receive payment. FINEART bears no responsibility for payments that cannot be processed due to missing or inaccurate PayPal information.

A 14-day holding period applies to all sales after delivery to the customer. During this period, customers may exercise their statutory right of withdrawal or request a return. Commissions for artworks that are returned will not be paid and will be deducted from any upcoming payouts.

If a customer refuses delivery of an order solely on the grounds of import duties, taxes, or customs fees, no refund will be issued to the customer. In such cases, the order shall be considered fulfilled and the Artist shall remain entitled to receive their full commission.

5. File Storage & Security

All high-resolution artwork files uploaded to the Platform are securely stored on offline lab servers. These files are used exclusively for the production of fine art prints as outlined in these Terms. Files are never sold, transferred, or disclosed to third parties for unrelated purposes.

Should your account be terminated, whether voluntarily or by FINEART, all artwork files associated with your profile will be permanently deleted. No backup copies will be retained.

6. Use of Artworks

By submitting artworks to FINEART, you grant us a non-exclusive, worldwide license to reproduce, display, and use your artworks strictly for:

  • Printing and selling artworks in the standardized formats described in Section 3
  • Marketing and promotional activities related to FINEART (e.g., social media posts, email campaigns, website features, exhibitions, or press releases)

Promotional use of artworks will always include proper credit to you as the Artist. For uses outside of standard promotional activities, FINEART will request your prior approval in writing.

7. Returns & Refunds

Customers may request returns in line with applicable consumer protection laws. In the event of a valid return, the Artist’s commission will be deducted from future payouts.

However, if a customer refuses delivery due to import duties, customs fees, or related charges, the sale will be considered final. No refund will be granted to the customer, and the Artist will remain entitled to receive their commission in full.

8. Termination

FINEART reserves the right to suspend or terminate an Artist account at any time, without notice, if the Artist breaches these Terms, submits infringing or inappropriate content, or otherwise acts in a manner contrary to FINEART’s standards and artistic vision.

Artists may also request termination of their account at any time by contacting FINEART at support@fineart.gallery. Upon termination, all associated artwork files will be deleted from our systems.

9. Governing Law

These Terms & Conditions are governed by and shall be construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located in France.

10. Acceptance

By registering as an Artist and submitting artworks for review, you confirm that you have read, understood, and agreed to these Terms & Conditions in full. Continued use of the Platform constitutes ongoing acceptance of any updated versions.
